April 21 2008 – Employing Foreign Nationals in the UK

The UK Border Agency began implementation of their new Points Based System (PBS) similar to that of Australia and New Zealand on 29 February 2008, initially affecting those applying to remain in the UK within Highly Skilled categories.

The UK Border Agency have advised that from the Autumn of 2008 the next phase of the PBS will be implemented and will replace the current work permit arrangements which allows foreign nationals to work in the UK for UK based employers.

The new procedure for overseas nationals applying to remain in the UK will be applied for under Tier 2 General or Tier 2 Intra Company Transfer for those transferring a foreign national from an overseas company to a UK company with the same ownership.

All employers wishing to employ or retain foreign national employees will have to apply and be approved for inclusion on a register of sponsors and obtain a Licence. The employer will have to provide the Border Agency with evidence of legal trading in the UK, agree to keep specific records and keep the Border Agency updated with any changes to the employment of the foreign national.

Employers who are found to be knowingly employing foreign nationals illegally are liable to a £10,000 fine or in serious cases custodial sentences.

This would seriously affect the ability of an employer to be approved for inclusion on the ‘Register of Sponsors’ which will be a mandatory requirement to employ foreign nationals from Autumn 2008.

The UK Border Agency has commenced processing of applications for Licences and you are urged to apply for this immediately. Applying now will avoid any delays with extending your foreign workers existing work permits or applying for employment permission for any new workers once the new policy of applying is implemented.
