IMMIGRATION POINTS BASED SYSTEM UPDATE

 

This contains new and important legal information that Company Directors, Business Owners and UK Employers need to be aware of and outlines the penalties, fines and criminal convictions possible if found to be employing illegal foreign workers.

 

Civil penalties were introduced to make it easier than ever to fine those employers who give jobs to people with no right to work without carrying out the proper checks.

Rogue employers will face civil penalties of up to £10,000 for each illegal worker they employ. Those found to have knowingly hired illegal workers could incur an unlimited fine and be sent to prison. The change comes as UKBA stepped up action in 2007 against illegal working by 40 per cent.

 

This is an update of the progress on the introduction of the new Points Based System

 

We have been informed that the uptake of Employers' applying for their Licence to enable them to sponsor foreign nationals under Tier 2 of the PBS has been very low. In fact there seems to be a certain amount of resistance and reluctance from the Commercial sector to apply for registration under the new Tier 2 Points Based System.

 

The Immigration Law Practitioners Association has advised that at a meeting on the 16/05/08 with the UK Border Agency, that the UKBA are very worried and concerned about sponsors not registering and applying for their licence.

 

Our expectation is that companies and Foreign Nationals will create a large volume of enquiries around their visa needs once the PBS is operational.

 

Our advice would be that all Companies and Organisations employing Foreign Nationals should submit their application for registration at the earliest opportunity.

 

The UKBA stated that the risk of not registering could cause log-jams and delays. This would mean if you were a company employing a Foreign National on a Work Permit and it needed to be extended but the employer was not registered in time that the individual would have to leave the UK before the expiry of their visa and wait in their country of Citizenship until registration and a totally new application was completed.

Many companies and individuals are just not aware of how the impact of these new policies could affect them.

 

 

WORK PERMIT SPONSORS AND HOLDERS

 

The Points Based System (PBS) will replace the current work permit arrangements which allow foreign nationals to work in the UK for UK based employers. The UK Border Agency (Home Office) has advised that this will be implemented from the end of Summer 2008.

 

The new procedure for overseas foreign nationals to remain in the UK will require Employers to apply under Tier 2 General. For those transferring a foreign national from an overseas company to a UK company with the same ownership it will require application under Tier 2 Intra Company Transfer.

 

All employers wishing to employ a foreign national or extend the employment of foreign national work permit holders employed under the existing work permit arrangements will have to apply and be approved for inclusion on a register of sponsors and obtain a Licence. The employer will have to provide the UK Border Agency with;

  • evidence of legal trading in the UK,
  • agreement to keep specific records and
  • notify changes to the employment of the foreign national.

The UK Border Agency has commenced processing applications from Employers for Licences and Ambler Collins suggests that you apply immediately. Applying now will avoid any delays with extending your foreign workers existing work permits or applying for employment permission for any new workers once the new policy of applying is implemented.

 

The process of applying for a Licence involves the submission of an on-line application followed by supporting documentation which must be presented within a set period of time. FINES FOR EMPLOYING ILLEGAL WORKERS

 

The new law allows for fines of employers who are found to be knowingly employing foreign nationals illegally, in serious cases an unlimited fine and custodial sentences up to two years. This is important information for Employers, Company Directors' and Business Owners who need to be aware of their legal responsibilities.

 

Home Office crackdown

 

Automatic bans from applying for a visa for a period of up to 10 years have been introduced for:

  • Overstaying your visa's validity
  • Working illegally
  • Lying on an application
  • Using false documents.

Visa applicants and their sponsors will get increased scrutiny. Even slight errors could lead to applications being turned down and payments forfeited.

 

"With the introduction of compulsory identity cards for Foreign Nationals later in the year, there can be no excuse for not checking the identity of those applying for jobs."
